Terms and Conditions

1. Acceptance of terms

These Terms and Conditions ("Terms") form an agreement between you and YallowHost ("YallowHost", "we", "us", or "our"). By creating an account, ordering, or using any YallowHost service, you agree to these Terms, our Privacy Policy, and any service-specific terms presented at order time. If you do not agree, do not use our services.

2. Eligibility and account responsibility

You must be able to form a legally binding contract to use our services. You are responsible for all activity under your account, for keeping your credentials confidential, and for enabling available security features such as two-factor authentication. Notify us promptly of any unauthorised use of your account.

3. Services covered

These Terms apply to the services we offer, which may include:

  • Web hosting and related platform services;
  • Domain registration and management;
  • Managed servers, where we handle selected technical responsibilities;
  • Unmanaged (cloud) servers, where you administer the server; and
  • SSL certificates and related add-on services, where offered.

4. Customer responsibilities

You are responsible for your use of the services and for all content, applications, and data you store, transmit, or process through them. You must use the services lawfully, respect the rights of others, follow these Terms, and not interfere with other customers or the stability and security of our infrastructure.

5. Accurate account and contact information

You agree to provide accurate, current, and complete account, billing, and contact information and to keep it up to date. Inaccurate information may prevent us from delivering services, processing payments, or contacting you about important matters, and may lead to suspension where required.

6. Billing, invoices, payments, renewals, and late payments

Fees are payable in advance. Recurring services renew automatically and generate an invoice ahead of each renewal date; one-time services are charged once. Services are activated or worked on after the applicable invoice is paid. If payment is not received by the due date, we may apply late fees where permitted and suspend or terminate the affected services. Prices may change with reasonable notice, and applicable taxes may be added. Except where stated in these Terms or required by law, fees are non-refundable.

7. Cancellations and service changes

You may request cancellation of a service from your account. For recurring services, cancellation stops future renewals; unless stated otherwise, the service remains available until the end of the paid period. We may add, modify, or discontinue features or services, and will provide reasonable notice of material changes where practicable.

8. Domain registration rules

Domain registrations are subject to the rules of the relevant registrar, registry, and ICANN.

  • Availability is not guaranteed until a registration is confirmed by the registry;
  • You must provide and maintain accurate registrant and contact information;
  • Renewals and expirations are your responsibility — failure to renew on time may result in suspension, additional redemption fees, or loss of the domain; and
  • Registry and registrar policies, including transfer, dispute, and data-publication rules, apply to your domains.

9. Hosting and server service rules

Hosting and server resources must be used reasonably and in line with any plan limits and fair-use expectations described at order time. We may take proportionate action to protect platform stability and other customers, for example where a service consumes excessive resources or is implicated in abuse. You are responsible for the security and maintenance of the applications and content you deploy.

10. Managed vs unmanaged services

The division of responsibility depends on the service you purchase:

  • Managed services — YallowHost handles the selected technical responsibilities described for that service.
  • Unmanaged services — you are responsible for the operating system, software, firewall, security, updates, backups, and configuration of the server, unless a separate managed arrangement is agreed in writing. We provide the underlying infrastructure but do not administer the server on your behalf.

11. Prohibited use

You must not use the services for any unlawful, harmful, or abusive purpose, including:

  • sending spam or unsolicited bulk messages;
  • phishing, fraud, or impersonation;
  • distributing malware or other malicious code;
  • hosting or distributing illegal content;
  • network abuse, port scanning, or interference with other systems;
  • copyright, trademark, or other intellectual-property infringement;
  • launching or participating in DDoS or other attack traffic;
  • attempting unauthorised access to any system, account, or data; and
  • abusing email or server resources in a way that harms others or the platform.

12. Suspension and termination

We may suspend or terminate your access to a service, in whole or in part, if you breach these Terms, fail to pay, create a security or stability risk, or where required by law or a third-party provider. We will use reasonable efforts to notify you, except where immediate action is needed to protect customers, the platform, or the public. You may terminate by cancelling your services as described in Section 7.

13. Backups and data responsibility

You are responsible for maintaining your own current backups of your content and data. Any backup feature we provide is offered as a convenience on a commercially reasonable basis and is not a substitute for your own backups. We are not responsible for loss of data that you have not independently backed up.

14. Third-party providers

Our services rely on third parties, including infrastructure providers, domain registrars and registries, and payment gateways. Your use of services that depend on them may also be subject to their terms, and their actions or outages may affect availability. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.

15. Service availability and maintenance

We aim to provide reliable services but do not guarantee uninterrupted or error-free operation. We may perform scheduled or emergency maintenance and will provide notice of planned maintenance where practicable. Any service-level commitments apply only where expressly stated for a specific service.

16. Limitation of liability

To the maximum extent permitted by law, YallowHost is not liable for any indirect, incidental, special, or consequential loss, or for loss of data, profits, revenue, or business, arising from or related to the services. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected service in the period giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless YallowHost and its personnel and providers from claims, damages, losses, and reasonable expenses arising from your use of the services, your content, or your breach of these Terms or of any law or third-party right.

18. Changes to services or terms

We may update these Terms or our services from time to time. When we make material changes to these Terms, we will update the date on this page and, where appropriate, provide additional notice. Your continued use of the services after an update means you accept the revised Terms.

19. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of- law principles, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.
